1. Registration
The use of the service welcometoaustria.at and welcometoaustria.mobi (“the Service”) is only permitted if concrete Terms of Use are observed.
The Service provides a wealth of information for planning trips to Austria. The user also has the opportunity of publishing contents (photos, evaluations and comments, other texts etc.) him or herself. The pre-requisite for using the Service is compliance with the concrete Terms of Use. Registration (including confirmation to validate the Terms of Use) is required for the publication of contents.
2. Entitlements and Responsibilities Associated with Use
The Service is intended to provide information, data and other content for personal non-commercial gathering of information.
The Service and the contents provided within the Service are legally protected. Any reproduction, dissemination and other use, especially commercial, publication, amendment and/or deletion by the users are prohibited.
The use of the content made available and search results may only be for personal, non-commercial purposes. The use of the Service for other purposes is expressly forbidden. Use of the Service in connection with commercial use of addresses, use for building up or adding to participant, company or other lists of any type in any form of media (printed, electronic, CD-ROM, etc), use for performing an information service such as a call-centre, use for giving telephone information, use for marketing and advertising purposes, use for creating products designed to compete with HEROLD products (especially the HEROLD CD-ROM and DVD product range, HEROLD single address sale etc), use for other commercial purposes and also generally for the purposes of, or in the interests of, third parties is not permitted in particular.
In addition, any use of the Service that could lead to damage, overloading or any other interference with the function of the Service, and also generally for illegal purposes, is not permitted.
The registered user has the possibility of incorporating content (particularly texts, pictures and photos) in the Service. The user is responsible for ensuring that the content which he provides is not illegal or unethical and that it does not breach the rights of third parties (especially copyright, branding and naming rights). In providing the content, the user guarantees that he is entitled, without restriction, to publish the content without infringing the rights of third parties, In particular, the placing of content which contravenes individual rights of third parties and also pornographic content, content which glorifies violence, inhumane, insulting, threatening, slanderous content, content which may encourage criminal acts or racist content and also content which makes political, religious and ideological judgements are expressly forbidden.
Evaluations can only be given if the user him/herself has used the Service to be evaluated. False and/or unobjective evaluations and comments must be avoided. All comments and evaluations must be worded objectively according to the knowledge and belief of the user.
The user is obliged, both upon registration and upon when making data available for publication, to make up-to-date, true and complete statements and to update these statements if there are changes. Any inputting errors are to be corrected without delay.
The user is responsible for the safekeeping of his access data. Passing on or opening up his access data is expressly forbidden. The user is liable for any unauthorised use of his account by third parties.
HEROLD has the right - without having to give any reason - to block the personal account of the user at any time and/or to delete the content supplied (also in part) and/or to exclude the user (permanently or temporarily) from the Service. In this case, the user has no claim for compensation against HEROLD.
The user is obliged to indemnify and hold HEROLD harmless if the conditions contained in these Terms of Use are contravened. In particular, the user is obliged to indemnify HEROLD in respect of all claims of third parties, including reasonable costs of legal proceedings based on non-contractual use, abuse and/or illegal use of the Service. The user is obliged to compensate HEROLD for damage suffered as a result of legal claims made by third parties.
3. Granting of rights
In publishing content the user transfers to HEROLD, free of charge and irrevocably, a right that is transferable, without restriction in terms of time, space and materially, to use the content in any form and in all media (particularly print, Internet, mobile communications platforms, etc.). This includes, in particular, the right to reproduce, disseminate and transfer, as well as the right to publish, the right to make publicly accessible, the right to send and reproduce through picture and sound carriers. In particular, the user agrees to transfer these rights of use to third parties.
4. Guarantee and Liability
HEROLD undertakes no guarantee in respect of the completeness and correctness of the placed content, for the uninterrupted availability of the Service or for the transport or transfer of data via the internet. In particular, it is possible that technical defects may lead to a loss of content which was provided and HEROLD is not liable for this.
HEROLD has no obligation in terms of operating the Service: HEROLD reserves the right to partially or completely stop or modify the Service, to block the access of individual users (even without prior announcement) or apply a charge for use of the Service.
In addition, HEROLD takes no responsibility for the legal admissibility, correctness and completeness of the content placed by the users; in particular, HEROLD has no obligation to check the placed content for legal admissibility, correctness and completeness. This also applies for external links which are placed by the users of the Service.
Content provided by users does not reflect the opinions of HEROLD even though HEROLD reserves the right to remove content from the website without prior announcement. Publications of user content do not represent statements, observations, evaluations, comments or recommendations on the part of HEROLD.
Liability claims against HEROLD which result from the use or non-use of the Service or from the provision of the content of the Service are prohibited in principle, unless this damage has been caused by malicious intent or gross negligence on the part of HEROLD.
5. Use of data and protection of personal data
The user agrees that all personal data that the user supplies when registering and when publishing content may be used for implementing and handling the contractual relationship and also for advertising and marketing purposes by HEROLD. By giving his e-mail address and telephone number, the user agrees to receive e-mails and telephone calls from HEROLD for advertising and marketing purposes. This declaration of agreement can be revoked at any time.
6. Other
If individual parts of these Terms of Use are or should become ineffective then this does not affect the validity of the remaining parts.
HEROLD reserves the right to make changes to the Terms of Use at any time. In using the Service, the user accepts the amended Terms of Use.
Contraventions of these Terms of Use will result in legal action.
Austrian Law applies.
The exclusive place of jurisdiction is the (monetary) competent court for the first municipal district of Vienna.
